10 WhatsApp Business Messaging
Where ERA operates or supports WhatsApp Business messaging on behalf of clients, the following requirements apply in accordance with Meta's WhatsApp Business Messaging Policy (last updated March 16, 2026) and related WhatsApp guidelines.
10.1 Opt-In Requirements
Clients and end users must provide explicit, affirmative opt-in consent before any WhatsApp Business message can be sent to them. Opt-in consent must:
Be obtained through an affirmative action by the user (e.g., checking a box, submitting a form)
Clearly identify the business name that will be sending messages
Explicitly state that the user will receive messages via WhatsApp
Disclose the types of messages the user will receive (e.g., transactional, marketing, support)
Not be assumed from a prior purchase, Terms of Service acceptance, or any pre-checked box
Not be implied or inferred from any other consent channel (e.g., prior SMS opt-in does not constitute WhatsApp opt-in)
10.2 Opt-Out
Users must be able to opt out of WhatsApp messages at any time. Upon receiving an opt-out request, ERA and/or the client must cease sending WhatsApp messages to that user promptly. Opt-out requests must be honored regardless of the channel through which they are received.
10.3 Messaging Windows & Templates
WhatsApp Business messaging is subject to the following window and template rules:
A 24-hour customer service messaging window opens each time an end user sends a message to the business
Free-form messages may only be sent within this 24-hour window
Outside of the 24-hour window, only Meta-approved message templates may be used
All business-initiated messages (including transaction alerts, appointment reminders, and promotional messages) must use templates authored and approved through Meta's system
10.4 Prohibited Content & Uses
WhatsApp Business messages must not be used to send, promote, or facilitate:
Illegal products or services
Fraudulent, deceptive, misleading, exploitative, or offensive content
Sexually explicit material or nudity
Hate speech, harassment, or content that promotes violence
Spam or bulk unsolicited messaging
Content related to terrorist or organized criminal activity
Sale of illegal drugs or controlled substances
Gambling services (where prohibited by law or Meta policy)
Unsafe dietary supplements or unapproved health claims
Tobacco, alcohol, or adult content where prohibited by Meta's Commerce Policy
Impersonation of another business, entity, or individual
Misrepresentation of ERA's or a client's affiliation, identity, or business nature
Any content targeted at or knowingly sent to persons under 18 years of age
10.5 Account Accuracy
Clients using WhatsApp Business services through ERA must provide and maintain accurate, current, and complete business information, including:
Valid legal business name
Verified business phone number
Accurate business description and category
Any other information required by Meta during onboarding or ongoing compliance reviews
10.6 AI & Automation Restrictions
As of January 15, 2026, Meta prohibits the use of general-purpose AI chatbots on the WhatsApp Business Platform. ERA's WhatsApp-connected automations are limited to:
Business-specific automation flows with clear, predictable outcomes (e.g., support bots, booking bots, order status bots)
Automations directly tied to a defined business purpose and service
General-purpose conversational AI or open-ended AI assistants may not be deployed on WhatsApp without explicit Meta authorization.
10.7 Policy Enforcement & Consequences
Violations of WhatsApp's Business Messaging Policy may result in:
A formal warning from Meta detailing the specific policy violation
Temporary restrictions on messaging volume or capabilities
Escalating restrictions for repeated or unresolved violations
Permanent suspension of the WhatsApp Business Account
Prohibition of the business and its associated organization from future use of WhatsApp Business products and services
ERA is not liable for any account suspension, messaging restriction, or service disruption resulting from a client's violation of WhatsApp's policies or these Terms.
